        Under our flat fee program, you retain your right to sell your home "By Owner".  You may sell your property directly to a buyer, and avoid paying a Realtor Commission.  (The FMLS listing fee of .0012, sales price $100,000, fee would be $120, you would be obligated to pay at closing.)  Our flat fee listing program allows you to maintain full control and accountability of your listing. It is your responsibility to maintain the accuracy of your listing data, which includes any changes in selling status. You will also handle all showing arrangements, offer negotiations, escrow, settlement and closing details.

11.  Full service assistance is available. (Optional Service)
        At any time during the life of your listing, we can assist you with offer negotiations, transaction paperwork, settlement and all closing details. We represent your best interests from initial offer negotiations all the way through to closing. We handle the communication with buyers, brokers, title companies, appraisers and lenders. This service is OPTIONAL and available at a cost of just 1 percent of the final selling price (minimum $1,000). If you are unable to show your property, Realty Group of North Georgia will make arrangements within their broker network to have your property shown. You pay the showing agent only what you have published as the Selling Agent Commission.

Q: What's the Main Reason You Should Use Our Service?
A:  Traditional Realtors are still charging 6 – 7% commissions for Homes, and often more for Raw Land / Lots.  We are offering you the same exposure + the ability to eliminate a sales commission altogether if you sell By-Owner.  If a Traditional Realtor does get involved in the sale, you’ll be paying about ½ what you normally would.  The main problem with the current market is that prices are dropping.  You don’t have as much “Profit Cushion” to pay out huge commissions + Buyers are increasingly low balling offers.  So we're offering you IDENTICAL Marketing Exposure – but we’re allowing you much greater flexibility in price negotiations when a Buyer finally does come.

  Realty Group of North Georgia, Inc. acting as Transaction Broker

Realty Group of North Georgia, Inc., hereinafter called RGNG, is a licensed real estate brokerage in the state of Georgia. This is a flat-fee limited service agreement. This agreement does not provide the same services as a “traditional” brokerage. You are paying a reduced flat fee rather than the more common percentage fee typically charged by full-service brokerages.
 
Using the services of RGNG does not create any agency or relationship between you and RGNG, and RGNG does not represent you. Once RGNG submits the Property information to FMLS the listing fee has been earned and is non-refundable. RGNG does not represent you, but is acting as a Transaction Broker.
 
The Georgia Real Estate Commission Official Code Section 10-6A-3 (14) defines “Transaction Broker” means a broker who has not entered into a client relationship with any of the parties to a particular real estate transaction and who performs only ministerial acts on behalf of none or more of the parties, but who is paid valuable consideration by one or more parties to the transaction pursuant to a verbal or written agreement for performing brokerage services”.
 
The Georgia Real Estate Commission Official Code Section 43-40-1 (5.1) defines “Ministerial acts” means those acts related to real estate brokerage activities which a licensee or a licensee’s employee performs and which do not require discretion or the exercise of the licensee’s own judgment.
 
The Georgia Real Estate Commission Official Code Section 10-6A-3 (12) defines “Ministerial acts” means those acts described in Code Section 10-6A-14 and such other acts which do not require the exercise of the broker’s or the broker’s affiliated licensee’s professional judgment or skill.
 
RGNG will provide such ministerial acts as stated in the listing agreement of the product you purchase. RGNG will enter your Property information into FMLS, forward all purchase offers to you from co-brokerage,  provide pre-printed real estate forms, possibly names of mortgage lenders, inspectors, attorneys, or similar information. None of these ministerial acts are considered as forming a brokerage engagement between RGNG and you. RGNG will not provide any assistance in any manner that would require it to exercise discretion or judgment. Examples include: suggesting a sales price, prepare or negotiate any contracts, nor does RGNG have any authority to act on behalf of SELLER.
 
Broker works to maintain its web site and services, but is not responsible for defects that may exist within its web site or any resulting loss of profits or other damages. Broker attempts to accurately enter the information you provide into FMLS. However, Broker does not guarantee error-free service. If you discover any error you must promptly notify Broker so the error can be remedied. Broker is not responsible for any loss or damage suffered by the error.
 
If you choose to withdraw your listing prior to the expiration date, you will be charged a fee of $35. FMLS charges an early termination fee.
 
At closing you will pay a FMLS transaction fee of .0012 of the sales price. This is a mandatory fee charged by FMLS that the SELLER is responsible for paying.
 
If a yard sign needs to be replaced during this listing period due to damage or theft the SELLER agrees to pay $50 to replace the sign. SELLER relieves RGNG and those working through this brokerage company from all liability in connection with any loss that may occur.
 
Realty Group of North Georgia, Inc. shall under no circumstances have any liability greater than the amount it received from you for its service. You agree to hold RGNG harmless from any and all claims, causes of action, or damages arising out of or relating to your providing incomplete and/or inaccurate information to RGNG.
 
Realty Group of North Georgia, Inc. is a Georgia Corporation and its FMLS listing service is intended for use only by persons owning property located in Georgia.
